Technical Customer and Real Estate Developer

At the modern stage of construction industry development, exact performance of duties and functions of a customer and real estate developer is the necessary condition of a successful object erection.

In order to anticipate appearing of different troubles, for example, out-of-season object handover by the real estate developer, a legal agreement is made, in which all obligations of a customer and a real estate developer, and also the terms of their implementation are strictly taken into account.

If the customer can not look after the process of construction because of his incompetence, or employment - the technical supervision of the customer gets organized. It is a crew of professionals, who take the duties of project documentation execution and exploration. Thus, certain specialists are engaged in an economic analysis, the others take control over the quality of materials and work of real estate developer and watch all the requirements and standards of customer, set by government to be observed. The technical supervision of a customer is also imposed with the function of building process management.

Depending on the scale of an object and special parameters of works, the followings functions of a real estate developer are distinguished:

  • erection of building objects flat-to-flat;
  • realization of planning and surveying programs;
  • signing of necessary documents on the project of construction and obtaining of permits for realization of different kinds of works according to the results of approval;
  • Elaboration and collation of estimate documentation;
  • fulfillment of economic analysis and technical control;
  • organization of engineering probes and construction standards supervision;
  • setting a building object to operation.

Thus, a construction customer gets great advantages in case of collaboration with a technical customer. The main things are real assets economy, construction reliability and confidence in its longevity.

A customer and real estate developer must work in a tandem to obtain the desired result. The contractor’s consent for the realization of supervision by a technical customer is not necessary, but measures which can be accepted while finding out drawbacks, construction errors or some other mistakes must be indicated in the agreement. Besides, the customer must not participate in operation or economic activity of the contractor.

As for a technical customer, in this case his duties consist not only in control and management. For a certain pay he can notarize project and legal documents, and also assert them in certain instances and co-ordinate with the construction customer, and get permissions for construction, certainly. A technical customer has the right to be engaged in registration of agreements about the insurance risks of different character. Thus, a technical customer is like a mediator between the customer of construction and the performer.

In hi turn, the real estate developer must observe all legislative norms, and also requirements and wishes of the construction customer.

Today it is very important to find a real estate developer, as the process of the real estate object construction requires a very attentive and professional concern. In the first place, a construction customer must find out if the real estate developer has all necessary licenses for the realization of these or those construction works.

After the construction of the object a construction customer without fail inspects it and tests. Besides, he personally or together with a technical customer checks up the accordance of terms of construction completion to those stated in the documents, fulfillment of all necessary norms by the real estate developer. In the case of finding out some discrepancies, the real estate developer can be deprived of the rights to realize his activity for the time being. The variant of bringing the real estate developer to responsibility for a non-performance or violation of legislative requirements is also possible.
