Approval

The desire to adjust one’s own dwelling to personal needs, to adapt it for the solution of specific tasks and to make it more comfortable is common for all people. Most common dwelling-houses have a small kitchen, long narrow corridors, pantries and close rooms. The desire to take away extra walls, change the door location, unite rooms is reasonable and clear. People were always engaged in rearrangement of apartments, but this process got a special scope at the end of 90th, after adopting the act of privatization.

In soviet times there was no necessity to approve rearrangement of apartments with supervisory organizations, it resulted sometimes in very sad consequences – bearing constructions were taken away, ventilation shafts got broken, loading got increased on ceilings. In 1998 the first decision, obligating to control the presence of an approval for rearrangement of apartments was signed. Before that time there was no common document that would regulate the processes of approval for rearrangement of apartments.

Today rearrangement is not only the improvement of housing conditions but also a time-consuming process directed to receive authorizations. Presently all the issues about approval of rearrangement are regulated by the Housing code, that went into effect on March, 1, 2005, according to which a citizen, who decided to make a rearrangement, should apply to self-governing authorities with an application. He must collect a package of authorizations that confirm that the forthcoming changes do not contradict to building norms and rules, do not infringe neighbors’ and house-owner’s rights, do not do violence to the architectural look and safety of the structure. The process of concordance for rearrangement ends with the permission from the housing inspection. The time of receiving of authorizations can last for months. That is why it is recommended to begin the approval of rearrangement in advance.

The process of approval n Moscow is completed when permission from the Moscow State Housing Inspection is received, providing that an apartment is situated in a dwelling-house. In this case the approval of rearrangement of apartment takes on the average 3 - 6 months. If changes are supposed to be made
in a separately standing non-residential premises, then the approval of rearrangement of non-residential premises will result in getting a permission for reorganization from the prefecture of the district. The order of approval of rearrangement in Moscow is established by Act № 37 of 09.29.99 "About the order of reorganization of apartments in dwelling-houses on the territory of Moscow", and also by the Decree of Moscow government № 883-ПП of 11.15.2005.

The first stage in the process of legitimation and approval of rearrangement is elaboration of project documentation. On this stage the desire to change the apartment must be arranged by drafts which are clear to the workers of those organizations which the concordance of rearrangement depends on. It is strictly recommended to entrust the elaboration of this stage to licensed project organizations. The final of the first stage of rearrangement approval will be the reception of technical conclusion about the state of constructions (TCC), which resumes technical possibility of rearrangement process.

Then the developed project must be signed in a number of supervisory organizations, which confirm the approval of apartments’ rearrangement, including sanitary-epidemiological supervision, state fire inspection architectural planning department, gas technical inspection, heat supply system, and also the owner of house (local building administration or housing cooperative). You may need additional documents depending on the complexity of changes, for example, electro-equipment project of apartment or its conditioning.

The finishing stage is the preparation of package of documents for the approval of rearrangement, which is given to a joint committee. It includes such all documents and agreements for the apartment, certificates from Technical Inventory Bureau, floor-by-floor building project, acts of approval with neighbors, copies of licenses and project organizations. Finally the matter about the concordance of rearrangement will be considered by the housing commission. The approval of rearrangement independently is a time-consuming and troublesome process, taking away much time and nerves. But it should be mentioned, that in case if a citizen has not completed the approval of rearrangement, then he can be exposed to penalty sanctions. At the same time he will be obliged within 2-3 months to fulfil the process of complete concordance of rearrangement. In case if it is impossible to co-ordinate the changes, then the apartment will have to be brought to a primary state.
